On October 1, 2024, at approximately 12:00 p.m., the James Bay Ontario Provincial Police (OPP) conducted a traffic stop on a vehicle on Highway 583 South in Hearst. Officers determined the driver had been consuming an intoxicating substance, and the driver was arrested and transported to the Hearst detachment for further testing.
The driver refused testing at detachment, and as a result of the investigation, Gaetan DORVAL, 51 years-of-age from Hearst, was charged with:
· Failure to comply with demand
· Drive vehicle with cannabis readily available
The accused was released from custody and is scheduled to appear before the Ontario Court of Justice on November 6, 2024, in Hearst. The accused was also issued a 90-day Administrative Drivers Licence Suspension (ADLS), and the vehicle was impounded for 7 days.
A refusal charge carries with it the same penalties as impaired driving, which if convicted, may include fines, imprisonment, and a further licence suspension of at least one year.
